Статтю присвячено розгляду питання щодо ролі, яку відіграють міжнародні суди у процесі міжнародної правотворчості. Авторка досліджує проблему визнання міжнародних судових інституцій як суб’єктів міжнародної правотворчості. Вона розглядає різноманітні наукові підходи щодо значення, яке мають судові рішення для правотворчого процесу у міжнародному праві: від їхнього класичного розуміння як допоміжних засобів для визначення правових норм до нового бачення рішень міжнародних судів як джерел міжнародного права. Крім того, у статті розглянуто діяльність деяких міжнародних судів та наголошено на їхній правотворчій потенції, а також проведено їхню класифікацію у контексті міжнародної правотворчості.
